Mass. AG Warns Consumers Against Advertising Complaints and Inaccurate Prices from Resellers

Massachusetts Attorney General Maura Healey on Wednesday warned car buyers to be aware of dealerships who may not accurately announce vehicle prices or honor those prices.

Healey’s office issued an advisory in response to an increase in consumer complaints alleging deceptive pricing practices by dealers. Approximately 74 such complaints have been filed over the past year.

The bureau said it received reports that some dealerships advertise specific prices online, but refuse them after interested car buyers come to the store. In some cases, resellers had confirmed the advertised price in an email, according to the complaints. Other car buyers have reported that dealerships fail to honor buyout provisions in leases.

“Buying a vehicle is a significant financial investment for many individuals and families,” Healey said in a statement. “After an increase in complaints at my office, we are making sure that consumers are aware of their rights under the law and that auto dealers know that our office will take action against these deceptive sales tactics.”

A shortage in the supply of new and used cars coupled with strong demand has driven prices up during the COVID-19 pandemic. Healey’s office said this created an environment conducive to auto advertising and price violations.

Dealers cannot refuse to sell a vehicle at the advertised price and they “must clearly and visibly disclose all included and excluded charges” in the advertised prices, as well as the expiration dates of those prices, the prosecutor’s office said. general in a press release.
